A woman recently found a metallic object inside an aloo patty sandwich she had ordered online. On reaching the District Consumer Disputes Redressal Commission in Mohali with the complaint and proof, she was awarded ₹35,000 as compensation. Scroll down to know what exactly happened.

According to Hindustan Times, complainant Tihij Sharma, a resident of Peer Muchalla, Zirakpur, had placed an order for an aloo patty sandwich from Subway through Zomato on April 16, 2024. While consuming the sandwich, she allegedly found a metallic object smaller than an earring inside it. After clicking photographs, the complainant contacted the food outlet through emails and other means but received no satisfactory response.

After that, she took the matter into her own hands and approached the District Consumer Disputes Redressal Commission in Mohali. The complainant, Tihij, presented photographic proof before the commission.

Sandwich Outlet Asked To Pay Compensation

During the proceedings, the opposite party failed to contest the complaint. According to Hindustan Times, the complainant’s affidavit, photographs, emails, and other documentary evidence also remained unrebutted. Under the Consumer Protection Act, 2019, supplying food containing a foreign object amounts to negligence, deficiency in service, and an unfair trade practice.

This is why the commission ruled that the responsibility to ensure food safety, hygiene, and quality rested with the seller who prepared and supplied the food product. The commission also dismissed the complaint against Zomato. According to them, the company acted as a logistics service and could not be held responsible for the negligence. 

The concerned Subway outlet was asked to pay ₹35,000 as compensation to the complainant for mental agony. Plus, it has also been directed to deposit ₹5,000 with the Tricity Consumer Courts Welfare Association and ₹10,000 with the PGI Poor Patient Relief Fund within 30 days.
