Kuwait Updates Citizenship Law With New 2026 Decree
The goal is simple to understand on paper. Keep the country’s identity safe. At the same time, address social and humanitarian issues. The balance, on the other hand, is in the details.
It states that Kuwaitis are those whose families lived in the country before 1920 and remained until late 1959. It also confirms that children born to Kuwaiti fathers are citizens by birth, regardless of where they are born. Foreign spouses no longer automatically become citizens. When minor children of citizens turn 18, they can choose their nationality. You have to make that choice within a year.
New Rules For Women And Their Families
The changes alter how nationality functions within families. A Kuwaiti woman does not lose her citizenship just because she marries a foreigner. She would have to take his nationality to do that. If she gets citizenship through marriage and then breaks up without kids, she might lose it.
Kids born to Kuwaiti mothers who are in tough situations, like having a father who is not there or is unknown, can be considered Kuwaiti until they turn 18, but only if the authorities agree.
Tougher Checks And Clear Penalties
The law tightens control where it matters most. Authorities can now use DNA testing and biometric checks in citizenship cases. The change aims to remove doubt and settle disputes faster.
Fraud carries serious consequences. Anyone caught giving false information could face up to seven years in prison, along with fines. Along with any associated benefits, citizenship acquired through fraud may also be revoked.
Sovereignty Is The Main Issue
One clause stands out because it has legal weight. Decisions regarding nationality are now deemed acts of sovereignty. That means a court can’t review them.
The Gulf News reports that this step aims to prevent lengthy legal disputes and expedite decision-making in sensitive cases. The law also gives the Public Prosecution full control over crimes related to nationality, which makes the process even stricter.

What Happens Next
The order goes into effect as soon as it is published. It also gets rid of older rules that don’t fit with the new system. For a lot of people, the changes may seem technical. But they affect real lives by deciding who belongs, who qualifies, and under what conditions.
