The Bombay High Court has issued an interim order restraining a Pune eatery from using the name ‘Burger King’ until the trademark infringement case filed by the international food joint is resolved. Earlier this year, the US-based Burger King Corporation challenged the Pune Court’s decision to dismiss the 2011 trademark infringement lawsuit.
Pune Eatery Restrained From Using ‘Burger King’ Name
In August this year, a Pune court dismissed the US-based Burger King Corporation lawsuit alleging trademark infringement against a namesake eatery in Pune. The international corporation took the matter to the Bombay High Court in the same month. According to NDTV, on December 2, the High Court restrained the Pune-based eatery from using the ‘Burger King’ name until the trademark issue was disposed of.
Reportedly, a bench of Justices A S Chandurkar, and Rajesh Patil on Monday, while passing its order on the interim application, said the appeal filed by the company needs to be taken into consideration and evidence needs to be looked into for them to make a final decision. Until then, the interim order will continue. As per reports, the court also directed both the appellant (Burger King) and the defendant (Pune-based eatery) to maintain their financial transaction records and tax documents of the last 10 years till the case is resolved.

US giant Burger King filed suit against the Pune-based eatery for using its name. According to them, this is causing “a huge loss and damage to the company and harming its goodwill, business and reputation.” The Pune Court had dismissed the 2011 suit filed by the Burger King Corporation. In their verdict, they said that the Pune eatery ‘Burger King’ was operating since 1992. This was way before the US eatery entered the Indian market. According to the international burger fast-food giant, the company has over 400 outlets in India and six of them are in Pune, establishing its wide reach.
