Shivputra Kumati from Belgaum Raibag Taluk in Karnataka bought a bottle of whiskey from a wine shop in Hubli. Pinto Wine Land is the name of the shop, which is situated near the railway station.

He tried returning the ₹650 bottle of Imperial Blue whiskey to the shopkeeper. The shopkeeper refused to exchange the bottle, saying it was not his fault but the manufacturer’s.

According to Shivputra, if the alcohol in the bottle had not been checked and had been drunk, there would have been a risk to life. He had filed a complaint against Vineland for service inadequacy under the Consumer Protection Act.

The Consumer Commission’s chairman, Eashappa Bhute, and members Vishalakshi Bolashetti, Prabhu Hiremath investigated the matter. Even after issuing the notice, Pinto Wine Land’s owner did not show up.

The owner said that there are many manufacturers who misuse the names of the brands and commit such offences. He said he could not be held accountable for such errors.

However, the first respondent, the owner, accepted that he had sold the bottle of Imperial Blue whiskey for ₹650 to Shivaputra, and was bound by the decisions of the Dharwad consumer court. Under the Consumer Protection Act 2000, a fine of ₹1.10 lakh was levied on the owner of Pinto Wine Land.

Dharwad consumer court passed a compensation and penalty on the wine shop as the complainant won.
