In a recent development, the US Embassy in India has warned tourist visa applicants against birth tourism. Any doubt of this can lead to a straight visa rejection. This warning comes at a time when US authorities are increasing scrutiny of visa applications. The announcement was made recently on the embassy’s official page on X. Here’s what you should know.

The US Embassy in India has now issued a tough warning for tourist visa applicants. In their recent post on X, officials made it clear that US consular officers can deny tourist visa applications if they believe the applicant is travelling to give birth. You should know that if this happens, the child automatically gets US citizenship, and, according to the officials, “This is not permitted.”
According to a report by India Today, this warning also emphasises a 2020 amendment to US visa rules. It explicitly makes it clear that consular officers have the right to reject B-1/B-2 visitor visa applications if birth tourism is suspected. The X post highlights that the US is strictly against birth tourism.

State Department Tightens Checks
As per India Today, the State Department in April also posted a message stating that using a US tourist visa as a shortcut to secure US citizenship is not acceptable. It not only abuses the system but also results in American taxpayers covering medical costs. The authorities also called their right to reject visas suspected of birth tourism one of their ways to serve and protect American taxpayers and communities.
The warning comes at a moment when the US is widening its social media checks. Reportedly, a new rule by the State Department now requires all H-1B workers and applicants, along with their H-4 dependents, to make their online accounts accessible for visa vetting, whether they are renewing a visa or applying for one. This new rule, which will roll out on December 15, has already made many Indian immigrants anxious. The US Embassy in India has also rescheduled a large number of H-1B and H-4 interviews. Some of the interviews are pushed as far as mid-2026.
