Food delivery aggregator Swiggy has landed in hot soup after a Bengaluru customer took the company to court. A man from Bengaluru dragged Swiggy to court for not only failing to deliver ice cream ordered by him on the app. But also, failing to give a refund for the same. A report by Bar and Bench stated that a man from Bengaluru ordered ‘Nutty Death by Chocolate’ from Cream Stone on Swiggy in January 2023. Despite paying a total of 187 for the order, the man did not receive his ice cream order. However, the order status on the Swiggy app showed ‘delivered.’ But the man didn’t get the ice cream ordered. On contacting Swiggy about the same, the food aggregator did not initiate the refund.

Court Orders Food Delivery App To Pay Compensation Of ₹5000

This led to the man approaching the consumer court. However, Swiggy retaliated by arguing that it only played the role of an intermediary between the customer and the third-party restaurant. And Swiggy was protected by the provisions of the Information Technology Act. The bench comprising of President Vijaykumar M Pawale, Renukadevj Deshpande and V Anuradha termed this as an “unfair trade.” Moreover, they directed Swiggy to pay compensation of ₹5000. 

In their verdict, the complainant proved Swiggy’s service was deficient as it failed to refund the amount despite its inability to deliver the ice cream order. The bench said this by itself shows clean unfair trade practice. While the customer demanded compensation of 10,000, the court called it “exorbitant” and directed Swiggy to pay 3,000 as compensation and 2,000 as litigation costs. This is along with the refund of 187 for the ‘Nutty Death by Chocolate’ ice cream.
