4-Year-Old Got Burnt By McDonald’s Chicken McNuggets; Family Receives $800K In The Lawsuit

A family got awarded $800,000 by a Florida jury in a lawsuit. The lawsuit alleges that a 4-year-old girl named Olivia Caraballo suffered from a severe burn by a hot Chicken McNugget. The family bought the fast food from a local McDonald’s franchise back in 2019. And now the family got this penalty because of the damages suffered due to this incident with McDonald’s.

The Family Sued The Local Franchise And The McDonald’s Corporation

Philana Holmes and Humberto Caraballo Estevez are the parents of the 4-year-old girl. The family sued the fast food franchise Upchurch Foods and the corporation. The little girl had to suffer from pain as she allegedly got second-degree burns, according to a report by NBC Media. She got burnt badly from the “unreasonably and dangerously” Chicken McNuggets of her Happy Meal. The lawsuit stated that a piece of chicken nugget stuck to the car seat and this led to burns on Olivia’s leg.

Back in May, a jury gave a split verdict, according to a report by NBC Miami. This jury in Fort Lauderdale found fault with the local McDonald’s franchise and its owner in the May verdict. The final decision on the financial penalty was taken on 19 May. The jury took about 2 hours to work on deciding the penalty that McDonald’s needs to pay the 4-year-old and her family for all her pain.

Olivia’s Family Asked For A Huge Penalty!

Reports state the family asked for $15 million because of this accident and its damages. The attorneys of Olivia’s family stated the financial penalty was “fair and just”. The lawyers also talked about the strong and courageous spirit of Olivia’s parents even when the case was getting polarised in the court. Philana Holmes shared with NBC Miami that she is happy as the jury delivered a fair judgment listening to Olivia.

McDonald’s Corporation and the franchise did not agree to such allegations and stated that they were not at fault. Later, the jury revealed that McDonald’s and Upchurch did not add any warnings on the hot Chicken McNuggets that led to the burns.
