What Is The New Media Law In Kuwait That Mandates A License For Influencer Ads?

As revealed by the Ministry of Information in Kuwait, it is preparing to introduce comprehensive rules for regulating social media advertising. The aim is to introduce comprehensive rules which require celebrities and influencers to obtain official licenses. They must do so before promoting products online. Here’s all you need to know about this new rule regarding advertisements by influencers.

Kuwait To Introduce Rules For Influencer Advertising

As mentioned in a report by the Gulf News, Kuwait has preparations to introduce comprehensive rules that can regulate social media advertising. These measures are a part of the new media law, which is under the final review. As it happens, the new rules are being introduced to address the concerns about misleading ads and to protect consumers from fraud.

So, influencers and companies will now have to prove that any advertised service or product has been legally licensed. This should be done with the Ministry of Information and the Ministry of Commerce and Industry. They are jointly responsible for issuing approvals.

It should be noted that the draft law has devoted two full chapters towards advertising, penalties for violations, and setting conditions for licensing. Once this comes into effect, the ministry will have authority for monitoring content across all social media platforms. Not to mention, suspected breaches will be referred to public prosecution.

Moreover, these violations will be met with legal consequences. However, with this being said, everyone will be given a window of time to adjust. These new rules come after a series of high-profile cases, in which the consumers claimed that they were duped by unverified influencer promotions.

So, once this rule comes into effect, advertisers will have to secure licenses through official channels. Moreover, the Ministry will also verify influence accounts. For this, they will require identity documents, an electronic application, and a signed pledge to comply with commercial advertising rules.
