If you are a Punekar and love burgers, you might know about the iconic Burger King outlets in Camp and Koregaon Park. The name of this famous eatery dedicated to burgers might be the same as the fast food giant Burger King Corporation but the companies are not the same. Owing to the confusion and a lawsuit by the American giant, Pune’s famous Burger King had to change their name to only Burger. However, the company finally emerged victorious in a legal case and it can officially retain its name after a very long time.

Pune’s Burger King Won A 13-Year Trademark Case Against Burger King Corporation

The legal battle between Pune’s Burger King and giant Burger King Corporation continued for 13 long years and concluded with Pune’s iconic Burger King winning the case on August 16. In 2011, Burger King Corporation filed a lawsuit against the owners of Pune’s Burger King, Anahita and Shapoor Irani for trademark infringement.

They filed the petition claiming that the owners violated the company’s trademark. In fact, the giant asked the local burger company to pay for damages, according to a report by NDTV Profit. Recently, a commercial court in the city rejected the giant’s trademark infringement lawsuit.

According to a report by Livemint, district judge Sunil Vedpathak spoke in favour of the local eatery and stated that it had been running in Pune even before the American corporation was established in the city. They are using the name and trademark before the fast food company registered its trademark in India. It was in 1989 when the corporation registered its trademark in our country.

The judge raised a point stating that the US fast food company did not use its trademark in India for almost three decades. Meanwhile, the local eatery used its own trademark during this span and continued business at all its outlets.

The confusion, a legal case of 13 years, and all the arguments concluded with Burger King securing its victory in this battle. The famous brand has reclaimed its original name and can start using it at their outlets.
