Recently, an incident involving two people consuming alcohol in public in Jammu and Kashmir went viral on social media. The two people were taking a ride on the famous Shikaras on the Dal Lake – a popular and scenic spot in Kashmir. The video drew the ire of a lot of people and the two unidentified gentlemen were subsequently apprehended. This has sparked a conversation about laws regarding alcohol consumption in the region.

Jammu and Kashmir is one of the strictest regions in India when it comes to alcohol. While it is not a completely dry state, possession, sale and consumption of alcohol is heavily regulated. One of the major reasons for this is socio-political and cultural.

As per the Excise Act of 1958, public consumption of alcohol is strictly prohibited. This is applicable all across the regions of Jammu and Kashmir. There may be a few areas where it may be legal. However, drinking is frowned upon in these regions.

Even in private spaces, alcohol consumption is permitted to those who have valid licenses. Consuming alcohol anywhere outside spaces deemed permissible is strictly disallowed.

Other Important Details You Should Know About The Laws

Apart from it being against the law, drinking while riding in the middle of the lake is dangerous and should not have been allowed. Passengers in inebriated condition could accidentally fall into the lake and drown.

The two unidentified people were arrested when the video went viral on X (formerly known as Twitter). It even drew the criticism of many religious leaders who condemned the act as un-Islamic. However, a more valid criticism of the act would be that it is unsafe.

This incident serves as a stark reminder to tourists to follow the local laws. As of now, there are a total of four states and one union territory in India that is completely dry. These are Nagaland, Mizoram, Gujarat and Bihar as well as Lakshadweep.
