US Government Plans On Banning Birth Tourism

The US Government is now planning to take one step ahead in the matter of immigration. It has now made it tougher for non-residents to get a US Visa. It has already threatened to end birthright citizenship, and now it is deliberating on to ban birth tourism. This means that no pregnant leady will be allowed to enter the country for tourism purpose. The Trump administration’s plans on banning birth tourism will lead to stricter visa application policies in a country where its already difficult to get a visa.

What’s In It?

It has been claimed by the government that the “Birth tourists” mainly come from countries like China, Russia and Nigeria. This is in order to prevent any foreign residents to take advantage of the  14th Amendment’s protection of citizenship for anyone born in the U.S. This new policy will make visa application stricter in a country where getting a visa was already a tough nut to crack. The new guidelines will primarily impact B1 and B2 non-immigrant visas also known as temporary visas for the purpose of business, tourism or medical treatment.

A draft obtained by a reputed global news agency states that under this rule if a consular officer is given any reason to believe that a B nonimmigrant visa applicant will give birth in the USA, then the applicant is assumed to be wanting a visa for the main purpose of obtaining a US citizenship for the child. So to refute this presumption, the visa applicant must be able to establish to the consular officer, that there is a legitimate primary purpose for visiting the USA, other than obtaining the US citizenship for the child by giving birth in the country.

One way to potentially clear this hurdle while obtaining a visa to the USA is by visiting the country on a B nonimmigrant visa. This visa allows people to enter the country for tourism, consultation with business associates or even to obtain medical treatment because the area they live in Mexico doesn’t have the proper medical facilities. The right-wing think tank of the Centre of Immigration Studies strongly advocates for lower immigration levels. In the year 2018, the government issued 5.7 million B1 and B2 visas in the fiscal year 2018, and there has been approximately 33,000 births per year to women who visited the United States on tourist visas and then left the country.
