US Visa Rules May Get Stricter
According to The Times of India, the Trump administration is preparing a fresh round of immigration rules that could change the H-1B visa programme, employment-based green cards and student visas. Reportedly, the authorities are planning to end the automatic extension of Employment Authorisation Documents (EADs).
This may significantly impact Indian professionals and students, as many H-4 visa holders in the US, mostly women, rely on these permits to work, become self-employed and obtain driving licences. If automatic extensions end and processing takes longer, many may not be able to continue working once their permits expire, leading to employment gaps.
Reportedly, H-1B rules may also become stricter. A proposed rule, expected in August 2026, would tighten eligibility for certain exemptions from the annual H-1B cap. It would also introduce stricter rules for companies placing H-1B employees at third-party client locations. Moreover, employers with a history of programme violations could face greater scrutiny. This change may impact several Indian IT and consulting companies.

Student Visa Rules May Also Change
According to News18, employers may also have to provide stronger proof of an employer-employee relationship. The US is also working on a proposal to increase wage levels for H-1B and employment-based green card applications. If implemented, the higher wage requirements could increase salary thresholds for entry-level positions, making it more expensive for employers to sponsor foreign professionals.
Reportedly, international students may also face new restrictions as the Department of Homeland Security plans to replace the current ‘duration of status’ system, which allows international students to stay in the US for the length of their approved academic programme, with fixed periods of admission for F-1 and J-1 visa holders.
This means some Indian students may need to apply for visa extensions if they wish to continue their studies beyond the authorised period. Along with these changes, the authorities are also planning higher immigration fees across several visa categories.
