The Model Code of Conduct (MCC) is a set of guidelines issued by the Election Commission of India (ECI) to ensure fair and free elections across the country. The MCC takes effect immediately once the election dates are announced and continues until the results are declared. It applies to political parties, their candidates, and all individuals, aiming to prevent unethical practices, ensure a level playing field, and promote ethical conduct among political participants.

The public is impacted by several rules and regulations contained in the MCC, especially those that deal with carrying and moving cash and other items during elections. Here’s what you should know about the MCC and what it means for you:

Carrying Cash

  • It is not permitted to carry more than ₹50,000 in cash without the required paperwork. If you are carrying this much money or more, you might be questioned by the police and asked to show supporting documentation that demonstrates the money’s legitimate source and intended purpose.
  • Authorities will report any cash found exceeding ₹10 lakh to the Income Tax Department for further investigation. If no satisfactory explanation is provided, the cash may be seized.

Carrying Other Items

  • Carrying gift items worth over ₹10,000 can also lead to questioning and possible seizure.
  • The excise laws of each state must be followed when transporting alcohol across state lines. Usually, there are restrictions on how much you are allowed to carry.

Surveillance And Seizure

  • At checkpoints, surveillance teams are stationed to keep an eye on the flow of money, alcohol, drugs, and other goods. To retain the element of surprise, these checkpoints are regularly moved.
  • Items you are carrying that are associated with a political candidate, agent, or party official could be seized. In the event that there is probable cause to suspect criminal activity, seizure will also take place.

What Happens After A Seizure?

  • Verification will be performed on seized money and goods to make sure they have no connection to any political candidate or party.
  • The items will be given back to you if it is determined that they have nothing to do with the elections or any crimes.
  • Complaints will be handled by a district-level committee in order to minimise disruption to the general public and sincere individuals. Every seizure case will be examined by the committee, which will then take the required action to rectify the situation.
